Terms of Service & Privacy Policy (New Zealand)

Last updated: 15th December 2025

1. Introduction

This website is operated by Rebecca Taylor Alexander (“we,” “us,” or “our”). By using this website or submitting a commission inquiry, you agree to these Terms of Service and Privacy Policy. If you do not accept these terms, please do not use the website.

This website currently accepts commission requests only. No online sales or payment processing occur on the site.

TERMS OF SERVICE

2. Commission Requests

  • All garments and accessories are handmade, and natural variations in colour, texture, or finish are expected due to the nature of materials and processes (including natural dyeing).

  • Submitting a commission inquiry does not guarantee acceptance of your project.

  • If we proceed, all pricing, timelines, materials, and design details will be confirmed in writing before work begins.

  • non-refundable deposit may be required to secure your commission. Once materials are purchased or work has begun, this deposit cannot be returned.

  • You agree to provide accurate information and timely communication throughout the process.

3. Custom-Made Items & Consumer Rights (NZ Law)

Because garments are custom-made to your specifications, the Consumer Guarantees Act 1993 allows for some exceptions:

  • Custom-made items are not required to be refunded if you change your mind.

  • However, you are still protected under New Zealand law:

    • The garment must be made with reasonable care and skill.

    • Materials must be of acceptable quality, considering their handmade nature.

    • We will act in accordance with our obligations under the Fair Trading Act 1986 and will not misrepresent our services or materials.

If a genuine fault occurs (not related to natural variation or client-provided measurements), we will work with you to remedy the issue in line with New Zealand consumer law.

4. Creative Process & Natural Variations

  • Natural dyeing and handcrafting involve inherent unpredictability. Colour, texture, and pattern outcomes may differ slightly from examples shown.

  • These variations are considered part of the artistic process and not defects.

5. Intellectual Property

  • All designs, images, text, photographs, and content on this website are the exclusive property of Rebecca Taylor Alexander.

  • You may not copy, reproduce, or use any content or designs without written permission.

  • Commissioning a garment does not grant you ownership of the underlying design or pattern.

6. Website Use & Conduct

You agree not to interfere with the functioning of the website, attempt to access secure areas, or use the site for unlawful purposes.

7. Limitation of Liability

To the fullest extent permitted under New Zealand law:

  • We are not responsible for indirect or consequential losses arising from your use of this site or our services.

  • We are not liable for delays caused by suppliers, natural dyeing processes, unexpected variations, or events outside our control.

  • You use this website and submit information at your own risk.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.
